4. Copyright of Architectural Drawings & Designs
All architectural drawings, designs, specifications, and documents produced by Focus Architects Limited remain the intellectual property of Focus Architects Limited at all times, regardless of whether fees have been paid in full. A licence to use such drawings is granted solely for the specific project and purpose for which they were prepared. This licence is conditional upon full payment of all outstanding fees and does not transfer ownership of the copyright. We reserve the right to withdraw this licence in the event of non-payment or breach of these terms. Drawings must not be reproduced, adapted, or used for any other project or purpose without our express written consent.
5. Professional Services
Our professional architectural services are provided under a formal Letter of Appointment or Client Agreement, which sets out the agreed scope of work, programme, and fee structure. These Terms and Conditions apply in addition to, and do not replace, any such appointment. Where there is a conflict between these terms and a signed appointment document, the appointment document shall take precedence. We reserve the right to suspend services in the event of non-payment of fees.
6. Fees & Payment
Our fees are agreed in writing prior to the commencement of any work. Invoices are payable within 14 days of the date of issue unless otherwise agreed in writing. We reserve the right to charge interest on overdue invoices at a rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. We also reserve the right to suspend or terminate services if invoices remain unpaid beyond 30 days.
7. Client Obligations
Clients are responsible for providing accurate, complete, and timely information required for the delivery of our services, including site access, survey data, and relevant planning history. Clients must promptly review and respond to documents, drawings, and correspondence submitted for approval. Delays caused by a client's failure to provide information or approvals in a timely manner may affect programme and fees. Clients are responsible for obtaining all necessary consents, approvals, and permissions unless expressly agreed otherwise in the appointment.
8. Limitation of Liability
To the fullest extent permitted by law, Focus Architects Limited shall not be liable for any indirect, consequential, or special loss arising out of or in connection with the use of this website or the provision of our services. Our total aggregate liability to any client in respect of any claim shall not exceed the total fees paid by that client for the specific project to which the claim relates. Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
